Faraid shares sourced from the Holy Quran, Surah An-Nisa (4:11-12 & 4:176), supplemented by the Sunnah and classical Fiqh (Hanafi school, predominant in Pakistan).
In Pakistan, Islamic inheritance law (Faraid) is enforced through the Muslim Personal Law (Shariat) Application Act 1962 and underpinned by Article 227 of the Constitution of Pakistan 1973.
Fixed Quranic shares (الفروض المقدرة) — 1/2, 1/4, 1/8, 2/3, 1/3, 1/6 — are assigned first to eligible heirs (Dhawu al-Furud); residue passes to residuary heirs (Asabah).
A Wasiyyah (will) is valid for up to one-third of the estate and cannot benefit a legal heir. Pakistan imposes no inheritance tax, though stamp duty and capital gains tax may apply on property transfers.
The Supreme Court of Pakistan (2025 SCLR 12) reaffirmed that inheritance shares for Muslims are fixed by the Quran and vest immediately upon death. Denying female heirs their mandated share is both unlawful and un-Islamic; the Enforcement of Women's Property Rights Act 2020 empowers female heirs to seek redress.
