Federal FMLA provides up to 12 weeks of unpaid, job-protected leave per year for eligible employees; up to 26 weeks for military caregiver leave. FMLA is administered by the Wage and Hour Division.
Employees must have worked ≥12 months and ≥1,250 hours in the prior 12 months at an employer with ≥50 employees within 75 miles. Short-term disability or employer-paid leave may supplement FMLA benefits.
State paid leave rates: California 70–90% (SDI); New York 67% (max $1,177.32/wk); New Jersey 85% (max $1,081/wk); Massachusetts 50–80% (max $1,170.64/wk); Washington 60–90%; Colorado max $1,381.45/wk. Rates current as of 2025.
Group health benefits must be maintained by the employer during FMLA leave under the same terms as if the employee had not taken leave.
