Eligibility criteria sourced from the U.S. Citizenship and Immigration Services (USCIS), Immigration and Nationality Act (INA), and the State Department Visa Bulletin (2026).
Family-based green cards are governed by INA §201–§203; immediate relatives of U.S. citizens face no annual numerical cap. Employment-based preference visas (EB-1 through EB-5) are subject to an annual cap of 140,000 visas.
The Diversity Visa Lottery allocates approximately 55,000 green cards annually to nationals of countries with historically low immigration to the United States. Applicants born in India, China, Mexico, Philippines, Canada, UK, and several other high-admission countries are ineligible for the DV Lottery.
EB-5 investors must invest a minimum of $800,000 (TEA) or $1,050,000 (non-TEA) and create at least 10 full-time jobs for U.S. workers. National Interest Waiver (NIW) allows EB-2 self-petition without an employer sponsor if the applicant's work benefits the U.S. national interest.
