Cannabis legality by U.S. jurisdiction varies significantly: 25 states plus D.C. have enacted recreational marijuana legalization for adults 21+. An additional 14 states operate medical cannabis programs. Decriminalization means possession of small amounts carries civil (not criminal) penalties in several more states.
Marijuana remains a Schedule I controlled substance under federal law. On December 18, 2025, President Trump signed Executive Order 14370 directing the DEA to expedite rescheduling cannabis to Schedule III; rulemaking is ongoing as of June 2026.
