Probate fee rates sourced from provincial probate legislation and court tariff schedules across all 13 Canadian provinces and territories — rates effective 2025–2026.
Ontario's Estate Administration Tax (EAT) is governed by the Estate Administration Tax Act, 1998 (S.O. 1998, c. 34): $0 on the first $50,000; 1.5% on the amount above $50,000.
British Columbia charges $6/$1,000 on $25,001–$50,000 and $14/$1,000 above $50,000 under the Probate Fee Act (BC S.B.C. 1999, c. 4).
Alberta caps probate fees at $525 for any estate over $250,000; Manitoba eliminated substantive probate fees in 2020 (flat $70 court filing fee).
Assets with named beneficiaries (RRSP, RRIF, TFSA, life insurance) and jointly-held assets pass outside the will and are generally excluded from probate in all provinces.
Quebec's notarial will requires no probate; holograph or witnessed wills in Quebec may require a will verification application before the Superior Court.
Legal / executor fees are estimated at 2.5%–5% of the gross estate — these are separate from the court probate fee and vary by province and complexity.
